“The degree to which this order violates Flash’s rights is so broad, it’s difficult to know where to start,” the motion reads, citing infringement of First, Fifth, Fourteenth, and Fifteenth Amendment protections.

That legal argument prevailed Tuesday, June 10, when a judge overturned a sweeping courthouse ban issued without authority by Jeff Davis County Judge Curtis Evans. The illegal order had barred me from entering any county building or coming within 300 feet of county officials. It was never part of my bond conditions and was never served to me. It simply appeared—posted at the courthouse—threatening me with arrest and jail in Hudspeth County if I violated it.

This ban wasn’t just extreme. It was unconstitutional. It blocked me from the courthouse, clerk’s office, tax office, sheriff’s department, and even the library—places every citizen has the right to access, especially a working journalist. The magistrate who originally set my bond included no such restrictions. The county judge just made them up.

But this week, we beat them in court. The judge struck the illegal order. And now, with one of the original charges already dropped, we’re continuing to fight for justice, accountability—and truth.

Jeff Davis County officials—including a judge and county attorney who later recused themselves—have been weaponizing the legal system against me in retaliation for my investigative reporting. It’s not just one act. It’s a pattern:

  • A false contempt warrant generated from a so-called “training exercise.”
  • A baseless arrest based on an encounter entirely caught on video.
  • A BOLO alert issued to harass me with repeated traffic stops.
  • Over $14,000 of taxpayer money spent to block records tied to these investigations.
  • And an illegal ban attempting to silence a journalist by locking him out of public buildings.

These are not isolated incidents. This is official oppression.

When Judge Mary Ann Luedecke falsely claimed I screamed, mocked, and ran from her office, I had the video. It showed none of that happened.

She wasn’t just wrong. She lied.

She claimed I fled—I walked calmly.
She claimed I said mocking things—I never did.
She even claimed she held me in contempt in court—there was no court.

When I confronted her about the false contempt warrant, she blamed “training exercises.” Then changed her story. Then admitted she “thought” they had a case. It’s a pattern of dishonesty from an elected official with the power to jail people—and no accountability. Yet she’s still on the bench.
